Terms of Service

1. Who we are

Arty Fitchel's is a service operated by Arty Fitchel's LLC, a Wyoming limited liability company (“we,” “us,” or “the Company”). By creating an account or using the service, you agree to these Terms of Service. If you do not agree, do not use the service.

2. What the service is

Arty Fitchel's provides a persistent AI companion platform. Your companion's memory and configuration are stored encrypted on Hedera Hashgraph's File Service (HFS). We cannot read your companion data — it is encrypted with a key derived from your passphrase and is only decrypted during an active session on your device.

The service routes your conversations to third-party AI model providers (such as Anthropic, OpenAI, Google, Mistral, and others). We do not operate these models.

3. Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account credentials and passphrase. Your passphrase is never stored by us — if you lose it, your encrypted vault data cannot be recovered.

You must be at least 18 years old to use this service.

4. Subscription and billing

Paid access to the service is billed at the price shown at checkout. Subscriptions renew automatically each month until cancelled. You may cancel at any time through the billing portal in your account settings.

Payments are processed by Stripe. We do not store your payment card details. Refunds are not provided for partial billing periods.

We reserve the right to change pricing with 30 days' notice to existing subscribers.

5. Promo codes and trials

Promo codes grant a limited-time trial period as specified at the time of redemption. Trial access is subject to these Terms. We may revoke trial access at our discretion if we suspect abuse. Each promo code may only be redeemed once.

6. Your data and ownership

You own the content you create and store in your companion vault. We do not claim any rights over it. Your vault data is encrypted before it leaves your device during a session and stored in encrypted form on Hedera HFS — we cannot access its contents.

Session audit records (session start, session end events) are logged to Hedera's Consensus Service (HCS). These records are public, permanent, and immutable by design — they cannot be deleted, including by us. They contain session metadata (session ID, token ID, timestamp) but not the content of your vault or conversations.

You may delete your account and all associated data (including encrypted HFS vault files) at any time through the Danger Zone in account settings.

7. API keys (BYOK)

You may provide your own API keys for AI model providers (“Bring Your Own Key”). These keys are stored in our database and used solely to route your requests to the provider you specify. You are responsible for your API key usage and any costs incurred with third-party providers. We are not liable for charges resulting from your API key usage.

8. Acceptable use

You agree not to use the service to:

• Generate or distribute illegal content
• Harass, threaten, or harm others
• Attempt to circumvent encryption, access controls, or account security
• Reverse engineer or extract proprietary components of the platform
• Use automated means to abuse the service (scraping, flooding, etc.)
• Violate any applicable law or regulation

We may suspend or terminate accounts that violate these terms without prior notice.

9. Third-party services

The service depends on third-party infrastructure including Hedera Hashgraph (storage and audit), Supabase (authentication and database), Stripe (payments), and AI model providers. We are not responsible for outages, changes, or data handling by these providers. Their own terms and privacy policies apply to their respective services.

10. Disclaimer of warranties

The service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure. This is an early-access product — features may change, and data loss, while unlikely, is possible. Maintain your own backup of anything critical.

11. Limitation of liability

To the fullest extent permitted by law, Arty Fitchel's LLC and its officers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or service interruption. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

12. Changes to these terms

We may update these Terms at any time. We will notify you by email or in-app notice before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Wyoming.
